CA Labor Board Sides With Teachers Against Outing Policy

On June 24th the California Public Employment Relations Board (PERB) issued a ruling in case SA-CE-3136-E, supporting teachers in their unfair labor practice complaint against the Rocklin school district due to the Gender Notification Policy. PERB has ordered the district to rescind its policy and to notify its employees of this change within 10 business days.

The teachers union contended that the district was in violation of the Educational Employment Relations Act because union members were denied the opportunity to bargain over the effects of the policy before the board voted to approve it. PERB concurred, but also resolved that because the board policy violated state law, it constitutes a nonnegotiable subject of bargaining and therefore forcing the union to enact this policy was illegal.

The district, led by the board members who forced this policy on Rocklin against the documented majority of our citizens who opposed it, have announced their intent to appeal. This will only result in more money paid to lawyers rather than being spent on the needs of students in our district.
